about the Kamyanets'-Podil's'kyi State Botanical Garden
1. General Provisions.
1.1 The Kamyanets'-Podil's'kyi State Botanical Garden is situated in Lesia Ukrayinka
Street. It was founded in 1930. The collection of the Botanical Garden is represented
by 2800 kinds, forms, sorts of tree, bush and herbaceous plants. It is the basis
of scientific researches and practice of the students of the Podil's'ka State
Agrarian Academy.
It became a reserve according to the Decree of the Council of Ministers of the
Ukrainian Soviet Republic No.1180-� of 07.03.63.
1.2 The total area of the Kamyanets'-Podil's'kyi State Botanical Garden is 17.7
ha. The user is Podil's'ka State Agrarian Academy.
1.3 The Kamyanets'-Podil's'kyi State Botanical Garden belongs to the nature
reserved fund of Ukraine, which is protected as national property, and is a
part pf the system of nature territories and objects, which are under special
protection.
1.4 Liquidation, reorganization of the Kamyanets'-Podil's'kyi State Botanical
Garden and change of its borders is carried out according to the legislation
currently in force.
1.5 The postal address of the land user:
Khmel'nyts'ka Oblast', Kamyanets'-Podil's'kyi, Shevchenko St., the Podil's'ka
State Agrairian Academy.
2. The purpose of foundation and aims of the Kamyanets'-Podil's'kyi State Botanical
Garden.
2.1 Kamyanets'-Podil's'kyi State Botanical Garden belongs to the nature reserved
fund of Ukraine.
2.2 The main aim of the Kamyanets'-Podil's'kyi State Botanical Garden is preservation,
studying of acclimatization of valuable and rare species and forms of plants
and preservation of the botanical collections.
2.3 The Kamyanets'-Podil's'kyi State Botanical Garden may be used with aesthetic,
educational, scientific, nature preserving, recreational, introductional and
selection-genetic purposes. Article 31 of the Law of Ukraine about NRF (nature
reserved fund) of Ukraine.
3. The regulations of the territory and protection of the Kamyanets'-Podil's'kyi
State Botanical Garden.
3.1 Any activities, which conflict with the aims of the state botanical gardens
and threaten to the collections of flora are forbidden on the territories of
the botanical gardens.
3.2 The territory of the botanical gardens is divided into several areas for
providing the necessary schedule of their protection and effective usage. They
are the following:
a) Exposition area - its visiting is allowed in order, established by the Administration
of the Botanical Garden;
b) Scientific area - the collections, experimental plots etc. belong to it,
only employees of the Botanical Garden have the right to visit it because of
their duties, and also specialists of other institutions by authority of the
Administration;
c) Reserved area - its visiting is forbidden except cases, when a scientific
research is going to be carried out there;
d) Administrative and Economic area.
3.3 Dividing into areas of the territory of the botanical gardens is carried
out according to the "Statute about the botanical garden" and "Project
of organization of the territory of the botanical garden", which is worked
out by specialized scientific and planning organizations.
3.4 Maintenance and reconstruction of the Botanical Garden is carried out according
to the projects, which are worked out by specialized scientific and planning
organizations and approved by the sevices, which the Botanical Garden is subordinated
to.
3.5 Owners or users of the allotments of nature objects, declared as the Botanical
Garden, take responsibilities of providing the order of its protection and preservation.
Article 32 of the Law of Ukraine "About the nature reserved fund of Ukraine".
3.6 Carrying out of such kinds of economic activities, which can damage the
Botanical Garden and break ecological balance.
3.7 Building of the buildings, which may cause change of the character of the
region and landscape, and bear losses to the Botanical Garden.
3.8 The exploration work, mining operations, transgression of the soil and flora.
3.9 Any littering or pollution of the territory of the Botanical Garden.
3.10 To give the land for bulding.
3.11 Other kinds of works that can break the natural connections and running
of the natural processes, loss of the scientific, economic and aesthetic value
of the Botanical Garden.
3.12 Abuse of the legislation of Ukraine "About the nature reserved fund
of Ukraine" and of the law "About the enviromnental protection"
causes the disciplinary, administrative, civil or criminal amenability.
3.13 The dimension of damage caused to the Botanical Garden is defined on the
basis of the approved tariffs.
3.14 All kinds of the usage of nature, which are carried out on the territory
of the Botanical Garden are realized according to the permission of the State
Administration of the Environmental Safety in Khmel'nyts'ka Oblast' within the
bounds, approved in fixed order.
The Statute is worked out on the basis of the Law of Ukraine "About the
nature reserved fund of Ukraine".
