STATUTE
of the state botanical nature monument of the local value,
Oak Forest
1. General Provisions.
1.1 The state botanical nature monument of the local value, Oak Forest. It is
a nature forest tract of oaks, more than 100 years. It grows nearby Slobidka
Smotryts'ka Village.
It became a reserve according to the resolution of Oblast' Executive Committee,
No.171 of 16.11.91.
1.2 The total area of the botanical nature monument of the local value, Oak
Forest is 4.8 ha. It is in the usage of the Slobidka Smotryts'ka Village Council,
Chemerovets'kyi Rayon.
1.3 The state botanical nature monument of the local value, Oak Forest, belongs
to the nature reserved fund of Ukraine, which is protected as a national property
and is a part of the system of nature territories and objects, which are under
special protection.
1.4 Liquidation, reprganization of the state botanical nature monument of the
local value, Oak Forest, and change of it's borders is carried out according
to the legislation currently in force.
1.5 The postal address of the land user:
Khmel'nyts'ka Oblast', Chemerovets'kyi Rayon, Slobidka Smotryts'ka Village,
Village Council.
2. The purpose and aims of foundation of the
state botanical nature monument of the local value, Oak Forest.
2.1 The state botanical nature monument of the
local value, Oak Forest, belongs to the nature reserved fund of Ukraine.
2.2 The main aim of the state botanical nature monument of the local value,
Oak Forest, is preservation of the unique nature tract, more than 100 years
old. The trees are aboriginal, old residents of Podillia.
2.3 The state botanical nature monument of the local value, Oak Forest, may
be used with aesthetic, educational, scientific, nature preserving and recreational
purposes.
3. The regulations of the territory and protection
of the state botanical nature monument of the local value, Oak Forest.
3.1 Any activities, which conflict with the
aims and tasks provided by the statute of the Reserve are limited or forbidden
on the territory of the Reserve.
3.2 The economic, scientific and other kinds of activities, which do not conflict
with the aims and tasks of the Nature monument, are carried out according to
the main requirements about the environmental protection.
3.3 Owners or users of the allotments of the nature objects, declared as a reserve,
take responsibilities about guaranteeing of the order of its protection and
preservation. The Law of Ukraine "About the nature reserved fund of Ukraine".
3.4 Carrying out of such kinds of economic activities that can damage the reserved
object and break ecological balance.
3.5 Building of the buildings that may cause change of the character of the
region and landscape, and make up losses to the reserved object.
3.6 The exploration work, mining operations, transgression of the soil and flora.
3.7 Any littering or pollution on the territory of the Nature Monument.
3.8 To give the land for building.
3.9 Other kinds of works that can break the natural connections and running
of the natural processes, loss of the scietific, economic and aesthetic value
of the Nature Monument.
3.10 Abuse of the legislation of Ukraine "About the nature reserved fund
of Ukraine" and the law "About the enviromnental protection"
causes the disciplinary, administrative, civil or criminal amenability.
3.11 The dimension of the damage, caused to the Nature Monument, is defined
according to the approved tarriffs.
3.12 All kinds of the usage of nature, which are carried out on the territory
of the Nature Monument are realized according to the permission of the State
Administration of the Environmental Safety in Khmel'nyts'ka Oblast' within the
bounds, approved in fixed order.
The Statue is worked out on the basis of the Law of Ukraine "About the
nature reserved fund of Ukraine".
